Program Overview

Texas Pete®/Garner Foods Inc. (“Sponsor”) agrees to cover the cost of branded table caddies with participating operators (“Operator”) under the following terms and conditions. The Sponsor will cover 100% of the total caddy cost as a marketing investment. Operator shall be responsible for the purchases of Texas Pete® products, subject to the conditions set forth herein.

Terms and Conditions

  1. Eligible Products
    Any mix of Texas Pete® products qualifies toward case requirements.
  2. Program Duration
    Operator shall meet the required case threshold within thirty-six (36) months from the program start date.
  3. Proof of Purchase
    The operator must provide quarterly proof of sales orders, uploaded to the assigned Regional Sales Manager (RSM).
  4. Shortfall Provision
    If Operator fails to meet the minimum case requirement within the 36-month window, Operator shall be invoiced for the total cost of the caddies.
  5. Ownership of Materials
    All table caddies provided under this Program are branded marketing materials and remain the property of Texas Pete®/Garner Foods, Inc. until the Operator has satisfied the case requirement in full.
  6. Non-Transferable
    This Program is offered exclusively to the participating Operator and may not be transferred, assigned, or sold.
  7. Limitation of Liability
    Texas Pete®/Garner Foods Inc. assumes no liability for Operator’s business performance, product sales, or any incidental costs incurred. Texas Pete’s/Garner Foods’, Inc. sole obligation is limited to covering the caddy cost under this Program.
  8. Termination Rights
    Texas Pete® reserves the right to discontinue or modify this Program at any time, provided that existing Operators shall receive reasonable notice and shall not be penalized for investments already made under agreed tiers.

Texas Pete® Caddies to be shipped to the Operator’s listed shipping address within 30 days of this agreement.
